POLAR MOTORS – VEHICLE SALES TERMS & CONDITIONS
These Terms & Conditions form part of the Sales Invoice issued by Polar Motors and apply to the vehicle purchase detailed on that invoice.
1. Deposit & Agreement to Purchase
A deposit is taken following an agreement to purchase and secures the vehicle for the customer. Once a deposit has been received, Polar
Motors may treat the vehicle as sold and decline further enquiries, viewings or offers.
If the customer subsequently chooses not to proceed for reasons unrelated to any breach by Polar Motors or their statutory rights, Polar
Motors may retain all or part of the deposit against losses reasonably incurred as a result of the cancellation.
If Polar Motors is unable to complete the agreed sale, the deposit will be refunded unless the failure to complete results from a breach of the
agreement by the customer.
2. Vehicle Condition
All vehicles sold by Polar Motors are used vehicles and their age, mileage, price and previous use should be taken into consideration when
assessing their condition.
Customers are encouraged to inspect and test drive the vehicle before purchase. Any known faults or defects specifically brought to the
customer's attention should be considered when deciding whether to purchase.
Nothing in these terms affects the customer's statutory rights, including their rights under the Consumer Rights Act 2015.
3. Agreed Work & Preparation
Any repairs, servicing, MOT work or other preparation specifically agreed as part of the sale will be recorded on the Sales Invoice.
Polar Motors will carry out the agreed work before collection unless an alternative arrangement is agreed with the customer.
4. Part Exchange Vehicles
Any part-exchange valuation is based upon the vehicle's condition and the information supplied by the customer at the time of valuation.
The customer confirms that they are legally entitled to dispose of the vehicle and that, to the best of their knowledge, information provided
regarding its mileage, condition, mechanical faults, accident history, ownership and outstanding finance is accurate. Any known
significant faults or damage must be disclosed.
Polar Motors may amend or withdraw the part-exchange valuation before completion if the vehicle's condition materially changes or
information supplied is found to be materially inaccurate or incomplete.
Where Polar Motors has agreed to settle outstanding finance, settlement will be based upon the information and settlement figure supplied.
5. Payment, Ownership & Collection
The vehicle remains the property of Polar Motors until cleared payment of the full purchase price has been received.
The customer should collect the vehicle on the agreed collection date shown on the Sales Invoice. If collection is delayed, the customer
should contact Polar Motors as soon as reasonably possible to agree alternative arrangements.
6. Warranty
Where a warranty is supplied, its duration and provider will be confirmed separately.
Any warranty is in addition to and does not replace the customer's statutory rights.
Warranty claims should be made in accordance with the warranty provider's terms where applicable.
7. Faults & Third-Party Repairs
If a fault develops which the customer believes Polar Motors is responsible for, the customer should contact Polar Motors as soon as
reasonably possible and allow us a reasonable opportunity to inspect the vehicle and, where appropriate, arrange a repair.
The customer should not authorise repairs, replacement parts or diagnostic work by a third party and expect Polar Motors to meet those
costs without our prior agreement, except where it would be unreasonable in the circumstances to contact us first.
Polar Motors will not normally be responsible for unauthorised third-party costs where we have not been given a reasonable opportunity to
inspect or remedy the fault.
Nothing in this clause affects the customer's statutory rights.
8. Customer Responsibility
The customer is responsible for the reasonable care, security and use of the vehicle while it is in their possession.
Any damage, deterioration or alteration occurring after sale which is unrelated to a fault for which Polar Motors is responsible may be taken
into account where relevant to any return, refund or other remedy, to the extent permitted by law.
9. Returns, Repairs & Refunds
Any request for rejection, repair, replacement, price reduction or refund will be dealt with in accordance with the Consumer Rights Act 2015.
Where legislation permits a deduction for the customer's use of a motor vehicle, Polar Motors reserves the right to make a reasonable
deduction for that use.
10. Vehicle Descriptions
Polar Motors takes reasonable care to ensure vehicle advertisements and descriptions are accurate.
The Sales Invoice records the vehicle being purchased and any specific work or preparation agreed as part of the sale. Any material error
identified before completion will be brought to the customer's attention.
11. Courtesy Vehicles
Any courtesy vehicle supplied remains the property of Polar Motors and is subject to the terms of the separate Polar Motors Courtesy
Vehicle Agreement.
12. Complaints
Any complaint should initially be made directly to Polar Motors so that we have a reasonable opportunity to investigate and resolve the
matter.
Our separate Complaints Procedure is available on request.
13. Statutory Rights
Nothing within these Terms & Conditions is intended to exclude, restrict or reduce any rights the customer has under the Consumer Rights
Act 2015 or other applicable consumer legislation.
